1. Scope of Work
IceHouse Customs (“IHC”) provides high-quality motorcycle repair, customization, performance tuning, electrical diagnostics, and restoration services. All work is performed with professional skill and attention to detail, in accordance with Swiss law (CO Art. 363–379). From vintage Harleys to modern cruisers, our technicians ensure a reliable and transparent service experience. All quotes and recommendations are made in good faith. Cost estimates are non-binding and may be revised if unforeseen issues or additional work becomes necessary. The customer will always be informed and consulted before proceeding with modifications beyond the original agreement.
2. Parts and Components
Unless otherwise specified, all parts installed are new and include a 12-month limited coverage, starting from the date of invoice or vehicle delivery (whichever is earlier).
Any used, refurbished, or customer-supplied parts are clearly identified and not covered, unless agreed in writing.
The full legal guarantee (Gewährleistung) under CO Art. 197–210 applies and cannot be waived in business-to-consumer contracts.
3. Coverage for Electrical and Electronic Components
All electrical/electronic components (e.g., regulators, ECUs, sensors) follow manufacturer warranty terms.
IHC is not responsible for component performance or failures beyond what is covered by the manufacturer.
Warranty claims for these parts must follow the manufacturer’s procedures (e.g., timeframe, return of defective part).
IHC may assist as a facilitator between the customer and the manufacturer but assumes no liability for the final outcome. We act only as a mediator, not as the guarantor of the manufacturer’s performance or obligations.
4. Responsibility, Fair Use & Inspection
Coverage applies only to parts and installations performed by IHC.
Coverage is void if:
The motorcycle is used improperly or abused.
The customer performs work on the vehicle without prior written authorization.
Unauthorized third-party repairs/modifications are performed.
Damage is caused by external factors (impact, water ingress, electrical surges).
Parts are subject to normal wear and tear or are consumables.
If failure occurs, the customer must make the vehicle or defective part available to IHC before any replacement or third-party work is performed.
5. Third-Party Work and Replacement by Other Shops
If a part installed by IHC fails and is replaced or worked on by another garage (in Switzerland or abroad):
The customer must notify IHC before any third-party intervention.
IHC may reimburse only the original invoice price of the part installed.
If the replacement part costs more than the original, IHC will only reimburse the original price.
Labor costs from external workshops are not covered, unless pre-authorized in writing.
Valid documentation (photos, invoices, and defective parts) must be submitted for any reimbursement consideration.
6. Price Protection
If a customer accepts a quote and the parts’ retail prices change by the time of ordering, IHC reserves the right to update the offer accordingly. The customer will be contacted for additional approval if required. IHC will not be held responsible for supplier-side price increases or stock delays.
7. Liability Exclusions
IHC is not liable for:
Loss of use or income during repair time
Indirect or consequential damages
Damages due to unauthorized modifications
Delays, travel, towing, or third-party assessments
Legal liability is limited to the scope permitted by CO Art. 100–103 (liability exclusions).
8. Parts Retention & Ownership
Replaced parts remain the property of the customer unless otherwise agreed. However, due to space and logistics, IceHouse Customs does not provide long-term storage of removed components.
If the customer wishes to retain the replaced parts, this must be requested and confirmed in writing prior to delivery of the vehicle.
The customer then has 30 calendar days from the vehicle’s delivery date to collect any removed parts. After this period, any unclaimed items will be considered abandoned and may be disposed of or recycled at IHC’s discretion.
This clause is compliant with CO Art. 213, and ensures that IHC is not treated as a storage facility for unclaimed items.
9. Down-Payments and Offers
For all confirmed work, a non-refundable down payment is required to cover the cost of ordered parts, unless explicitly waived in writing.
Once the parts arrive, IHC will proceed with the service. The final invoice will reflect the total cost of the job minus the deposit already paid.
No work will begin until the down payment has been received.
10. Right of Retention
In accordance with CO Art. 895 and CO Art. 91–92, IHC reserves the legal right of retention (Droit de Rétention / Diritto di Ritenzione) over the vehicle until the full settlement of the invoice is received.
Vehicles will not be returned until all outstanding balances have been paid in full.
Legal collection fees and administrative charges may be added in case of non-payment.
IHC reserves the right to charge CHF 10.– per calendar day for storage of unpaid or uncollected vehicles beyond 7 days from the invoice date.
11. Invoicing & Payment Terms
Discounts are granted solely at the discretion of IHC and are not guaranteed.
Invoices must be paid before or on the day of pickup of the vehicle, and no later than 7 working days from the date of completion, unless otherwise agreed in writing.
If payment terms have been extended, the due date must be respected to avoid legal action, collection proceedings, or penalties.
In case of late payment (beyond 30 days), IHC reserves the right to apply a 5% surcharge on the total outstanding amount, with a minimum of CHF 20, in addition to any ongoing parking/storage fees.
12. Changes to These Terms
IHC reserves the right to amend these terms at any time. Updated terms will be published on our website and apply immediately to ongoing and future work.
13. Severability Clause
If any provision of these Terms is found invalid under Swiss law, the remaining provisions will continue in full force. Invalid clauses will be replaced with legally valid terms that reflect the original intent as closely as possible (CO Art. 20a).
